1. The PickleballSponsor Service

PickleballSponsor provides an online platform that helps sponsors discover sponsorship opportunities and helps organizations, businesses, individuals, events, clubs, and other opportunity providers connect with potential sponsors.

PickleballSponsor may provide features including:

• sponsorship opportunity listings
• organization and user profiles
• search and discovery tools
• sponsorship benefit categories and ratings
• internal messaging or contact tools
• email notifications
• recommendations and matching tools
• links to third-party websites
• other tools designed to help sponsors and opportunity providers connect

PickleballSponsor provides the platform and connection service only.

2. We Are Not a Party to Sponsorship Agreements

Top Position Web Design, LLC and PickleballSponsor are not parties to sponsorship agreements, transactions, arrangements, or other relationships entered into between users.

Unless we expressly state otherwise in writing, we do not act as an agent, broker, representative, employee, partner, joint venturer, fiduciary, or advisor for any user.

Sponsors and opportunity providers are solely responsible for negotiating and agreeing upon the terms of their sponsorship relationships. This includes responsibility for:

• sponsorship prices
• payments
• sponsorship benefits
• advertising placement
• exclusivity
• sponsorship duration
• products or services exchanged
• event participation
• fulfillment
• cancellations
• refunds
• taxes
• legal compliance
• disputes between the parties

Any agreement resulting from a connection made through PickleballSponsor is between the users involved.

3. We Do Not Process Sponsorship Payments

PickleballSponsor does not collect, hold, transfer, distribute, or process sponsorship payments between sponsors and opportunity providers.

Users are responsible for arranging payment directly with each other.

PickleballSponsor is not responsible for payments, nonpayment, refunds, chargebacks, disputed transactions, unauthorized transactions, taxes, or financial losses arising from arrangements between users.

4. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to create an account or use PickleballSponsor to enter into sponsorship arrangements.

If you use PickleballSponsor on behalf of a company, club, organization, event, or other entity, you represent that you have authority to act on behalf of that entity and bind it to these Terms.

5. User Accounts

You may be required to create an account to use certain features.

You agree to provide accurate information and keep your account information reasonably current.

You are responsible for activity occurring through your account and for maintaining the security of your login credentials.

You must notify us if you believe your account has been compromised or used without authorization.

We may suspend, restrict, or terminate accounts that we believe have been compromised, misused, or operated in violation of these Terms.

6. Sponsorship Listings

Users who create sponsorship opportunities are responsible for the accuracy and legality of their listings.

By creating a listing, you represent that:

• you have authority to offer the sponsorship opportunity
• the information you provide is accurate to the best of your knowledge
• you have the right to use any names, logos, photographs, trademarks, or other material included in the listing
• the opportunity is genuine
• the listing is not intentionally false, deceptive, or misleading
• the listing does not violate applicable law or the rights of another person or organization

You are responsible for keeping your listings reasonably accurate and current.

7. No Verification or Guarantee

PickleballSponsor may review, moderate, categorize, or remove information submitted to the service, but we are not required to independently verify users, organizations, sponsorship opportunities, claims, statistics, identities, authority, or representations.

We do not guarantee:

• that a user is who they claim to be
• that a user has authority to represent an organization
• that a sponsorship opportunity is available
• that information in a listing is complete or accurate
• event attendance, audience size, website traffic, social media reach, or impressions
• sponsorship value, exclusivity, financial condition, or fulfillment

Users should perform their own due diligence before entering into a sponsorship arrangement.

8. Sponsorship Benefits and Ratings

PickleballSponsor may identify, categorize, estimate, score, rank, or describe potential sponsorship benefits (brand awareness, local recognition, SEO value, lead generation, social exposure, community goodwill, etc.).

These categories, scores, ratings, weights, recommendations, descriptions, and estimates are provided for informational and discovery purposes only. They are not guarantees, warranties, promises, financial projections, or professional marketing advice. Actual sponsorship results may vary.

9. No Guarantee of Results

PickleballSponsor does not guarantee that use of the service will result in receiving a sponsorship, finding a sponsor, receiving inquiries or responses, generating leads, increasing sales, acquiring customers, increasing website traffic, improving search engine rankings, or producing any particular return on investment.

10. Communications Between Users

PickleballSponsor may allow users to contact or communicate with other users. You understand that messages sent through the service may be forwarded, delivered, or summarized by email or other electronic means.

PickleballSponsor is not responsible for statements, promises, offers, representations, attachments, links, or other information exchanged between users. You are responsible for your own communications and interactions with other users.

11. Service Communications

By creating an account or using features that require communication, you agree that we may send you communications reasonably related to your use of PickleballSponsor. These include account verification messages, security notices, user inquiries, listing notifications, support responses, administrative notices, and updates to these Terms or Privacy Policy.

12. Marketing Communications

We may also send promotional or marketing communications about PickleballSponsor, sponsorship opportunities, new features, services, educational content, announcements, and related offerings where permitted by applicable law.

Marketing emails will provide a method to unsubscribe from future marketing communications. Unsubscribing from marketing communications does not prevent us from sending service-related, security, account, legal, or other non-promotional communications when appropriate.

13. User Content

You retain ownership of User Content you submit (organization details, opportunities, descriptions, logos, photos, videos, trademarks, links, messages).

By submitting User Content to PickleballSponsor, you grant Top Position Web Design, LLC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, resize, adapt, distribute, and otherwise use that content as reasonably necessary to operate, improve, promote, and market PickleballSponsor.

14. User Responsibility for Content

Users are solely responsible for User Content they provide. We do not endorse User Content merely because it appears on PickleballSponsor.

15. Moderation and Removal

We reserve the right, but do not assume an obligation, to review, edit, reject, hide, restrict, remove, or disable access to User Content or accounts for inaccurate information, suspected fraud, misleading listings, spam, abuse, intellectual property complaints, or violations of these Terms.

16. Prohibited Conduct

You may not use PickleballSponsor to commit fraud, impersonate others, post fake opportunities, send spam, harvest email addresses, distribute malware, scrape or systematically extract information without written permission, or use automated scripts/bots to collect or copy database content.

17. Intellectual Property

Except for User Content, the PickleballSponsor website, software, source code, database structures, branding, logos, written content, scoring systems, and benefit frameworks are owned by or licensed to Top Position Web Design, LLC.

18. Third-Party Websites and Services

PickleballSponsor may contain links to third-party websites or services. We do not control those third parties and are not responsible for their content, accuracy, privacy practices, security, or transactions.

19. Disputes Between Users

Disputes arising from sponsorship arrangements, communications, payments, promises, or performance between users are strictly between those users.

20. Release

To the maximum extent permitted by applicable law, you release Top Position Web Design, LLC and its owners, officers, employees, contractors, agents, and service providers from claims, demands, and damages arising out of disputes with other users or third parties.

21. Disclaimer of Warranties

To the maximum extent permitted by law, PickleballSponsor is provided on an "as is" and "as available" basis without warranties of any kind.

22. Limitation of Liability

To the maximum extent permitted by applicable law, Top Position Web Design, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Total aggregate liability will not exceed the greater of $100 or the amount you paid directly to us during the preceding 12 months.

23. Indemnification

You agree to defend, indemnify, and hold harmless Top Position Web Design, LLC from claims, liabilities, damages, and expenses arising from your use of the service, User Content, sponsorship opportunities, or violation of these Terms.

24. Copyright Complaints

If you believe content appearing on PickleballSponsor infringes your intellectual property, contact us with details so we may review and take appropriate action.

25. Privacy

Our collection, use, and handling of personal information is described in our Privacy Policy.

26-33. General Terms

We may modify or discontinue features at any time. We may update these Terms from time to time. These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles.
